This Privacy Policy explains how Regulars Kit ("Regulars Kit," "we," "us," or "our") collects, uses, shares, and protects personal information when you visit regularskit.com, use our free calculator, buy or use The AI Client Toolkit, subscribe to Regulars Promo (regularskit.com/app), use our support chat, or contact us (together, the "Services").
Regulars Kit is a product of Jailton Cardoso, a business owner based in Brazil (CNPJ 37.200.262/0001-00), who is the controller of the personal information described here.
By using the Services, you acknowledge this Policy. Our Terms of Service also apply.
The Services are made for small local businesses in the United States and the people who run them. They are not intended for anyone under 18, and we do not knowingly collect personal information from anyone under 18. If you believe a minor has given us personal information, email [email protected] and we will delete it.
Please do not send us passwords, payment card numbers, health information, or patient or client personal information (including protected health information, "PHI"). The Services are not designed to receive it.
We use personal information to: 1. Provide the Services: show your calculator result, grant access to the toolkit you bought, send sign-in (magic) links, run Regulars Promo, track your image credits, and store your Outputs. 2. Communicate with you: send transactional emails (sign-in links, receipts-related notices, onboarding, service and policy notices) and answer support requests. 3. Marketing: if you used the free calculator, send your estimate and a short series of tips emails (5 emails over about 10 days, then no further marketing emails). You can unsubscribe at any time (Section 5). 4. Security and abuse prevention: rate limiting, fraud and bot prevention, and enforcing our Terms. 5. Improve the Services: understand which pages, niches, and campaigns work, in aggregated or de-identified form where practical. 6. Legal: comply with tax, accounting, and other legal obligations, and establish, exercise, or defend legal claims.
Legal bases (GDPR/LGPD, where they apply): performance of a contract (providing what you bought or requested); consent (marketing emails from the calculator, which you can withdraw anytime); legitimate interests (security, fraud prevention, improving the Services, direct marketing to business contacts where allowed); and compliance with legal obligations.
AI and automated decisions: we use AI services to generate images from your Inputs and to answer support chat questions. We do not make decisions that produce legal or similarly significant effects about you based solely on automated processing.
We do not sell personal information, and we do not share it for cross-context behavioral advertising. We share it only as follows:

Other cases: (a) to comply with law, legal process, or a valid request from authorities; (b) to protect the rights, safety, and property of Regulars Kit, our users, or others; (c) in connection with a merger, sale, financing, or transfer of all or part of the business, in which case this Policy (or an equally protective one) will continue to apply; and (d) with your direction or consent.
Third-party tools mentioned in the toolkit (for example, ChatGPT or the tools in Bonus #2) are separate companies. When you use them, their own terms and privacy policies apply, not ours.
We are based in Brazil, and our service providers process data in the United States and other countries. By using the Services, your information will be transferred to and processed in countries whose data protection laws may differ from yours. Where required (for example, under the LGPD or GDPR), we rely on appropriate safeguards, such as the providers' standard contractual clauses or data processing terms.
You can block or delete cookies in your browser settings, but essential features (like staying signed in) may stop working.
We keep personal information only as long as we need it for the purposes above, then delete or de-identify it:
We use reasonable technical and organizational measures to protect personal information, including HTTPS encryption in transit, passwordless sign-in with single-use expiring links, hashed tokens and session IDs, secure HttpOnly cookies, hashed IP addresses for rate limiting, bot protection, and limited access to production systems. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security. Keep access to your email inbox secure, because anyone who can open it can request a sign-in link. If we learn of a security incident affecting your personal information, we will notify you and authorities as required by law.
Depending on where you live, you may have the right to: - know/access the personal information we hold about you and get a copy (portability); - correct inaccurate information; - delete your information; - withdraw consent or opt out of marketing at any time; - object to or restrict certain processing; - appeal a decision we make about your request (where state law provides it); and - lodge a complaint with a data protection authority.
To exercise these rights, email [email protected] from the email address linked to your account or purchase. We may need to verify your identity before acting. An authorized agent may submit a request on your behalf with proof of authorization. We will respond within the time the applicable law requires. We will not discriminate against you for exercising your rights.
To the extent the California Consumer Privacy Act (as amended by the CPRA) or similar US state privacy laws apply to us: - Categories collected (last 12 months): identifiers (email, hashed IP, account and order IDs); commercial information (products bought, subscription status, credits); internet or network activity (log and technical data); and content you provide (business details, logos, prompts, support messages). We do not intentionally collect sensitive personal information. - Sources, purposes, and recipients: as described in Sections 2 to 4. - No sale or sharing: we do not sell personal information and do not share it for cross-context behavioral advertising, and we have not done so in the last 12 months. We do not knowingly sell or share the personal information of consumers under 16. - Retention: see Section 8.
Jailton Cardoso is the controller. You may exercise the rights in Article 18 of the LGPD (confirmation, access, correction, anonymization, blocking or deletion, portability, information about sharing, and withdrawal of consent) by writing to our contact for data protection matters (encarregado) at [email protected]. You may also petition the ANPD (Autoridade Nacional de Proteção de Dados).
The Services are aimed at US businesses, but if the GDPR or UK GDPR applies to you, you have the rights listed above, and the legal bases we rely on are listed in Section 3. You may complain to your local supervisory authority.
The toolkit gives you message templates that you send from your own phone or email. We do not send messages to your customers and do not receive your customer lists through the toolkit. You are responsible for how you collect and use your own customers' information and for your compliance with laws such as the TCPA, CAN-SPAM, and state privacy laws. Do not enter your customers' personal information, or any patient information or PHI, into Regulars Promo, the support chat, or any of our forms. Regulars Kit is not a HIPAA covered entity or business associate and does not sign business associate agreements.
We may update this Policy from time to time. We will post the new version on this page with a new effective date and, for material changes, give notice by email or on the site where appropriate. Your continued use of the Services after the effective date means the updated Policy applies.
